Introduction

VIDEO CALL LLC, a Delaware limited liability company, with its principal place of business at 1209 N Orange Street, Wilmington, DE 19801, United States ("VIDEO CALL LLC"), is responsible for maintaining this video calling service ("video-call.us").

By accepting this Privacy Policy, the User fully agrees to its terms and also freely and expressly consents to video-call.us collecting, using, storing and processing their information, which will be necessary for the service offered to be provided in its entirety, reinforcing that video-call.us follows rigorous international security and protection standards for this information, such as the ISO27001 Information Security Management Standard, compliance with the Health Insurance Portability and Accountability Act (HIPAA) of the United States, as well as the requirements of the General Data Protection Regulation (GDPR) of the European Community.

"Personal Data" is information that can be used to identify you, directly or indirectly, alone or in conjunction with other information. This includes information such as your full name, email address, and phone number.

"Sensitive Personal Data" is data that reveals racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, genetic data, biometric data for unambiguous personal identification purposes, data concerning health status or a person's sex life and/or sexual orientation.

video-call.us collects, uses, discloses and processes Personal Data as described in this Privacy Policy, including to operate and improve the services and our business, as described in more detail in this Privacy Policy.

We may create anonymous or de-identified data from personal data by excluding data components (such as your name, email address, or linkable tracking ID) that make the data personally identifiable to you, through obfuscation or other means. Our use of anonymous and de-identified data is not subject to this Privacy Policy.

video-call.us does not directly collect Sensitive Personal Data, but is fully aware that this data may be collected directly by Users in their relationship with their patients/clients and stored for processing in the service. In this way, video-call.us maintains the same protection and security processes for this data, but warns that Users, as data controllers, must follow the same protection criteria, with video-call.us not being responsible for acts performed by Users, as described in more detail in this Privacy Policy.

We advise that the entire text should be read carefully and, if you do not agree with the content of our Privacy Policy and/or Terms and Conditions of Use, do not proceed with browsing or using our services. We also recommend that if accepted, you store or print a copy of this agreement, including all policies.

1. Availability

2. User Privacy and Security

2.1. Protecting your privacy is very important to us. Your passwords are stored on video-call.us servers in encrypted form using the Advanced Encryption System. Connection security is also guaranteed by the HTTPS protocol. When transmitting sensitive information, you should always ensure that your browser is able to validate the appropriate certificates.

2.2. video-call.us values the protection of information entrusted to us, as well as the quality of the system, maintaining a conduct of high respect for the privacy of its Users and the patients/clients of our Users. Thus, Users are recommended to have similar conduct and take the utmost care to protect the privacy and confidentiality of their patients, in accordance with applicable professional codes of conduct, the United States Constitution, consumer protection laws, criminal law and all national and international standards, such as HIPAA and GDPR. It is emphasized that acts performed by Users are not the responsibility of video-call.us, including violations of this clause.

2.3. video-call.us strongly recommends that the User formalize the consent for electronic recording of information from their patients/clients, in compliance with the General Data Protection Regulation and that, according to clause 2.2, observe all security and protection requirements.

2.4. By accepting this document, the User acknowledges and agrees that video-call.us may disclose their account information when required by public authorities, with preservation or disclosure acts aimed at:

  • a) Satisfying any applicable law, regulation, legal process or governmental request;
  • b) Enforcing this Privacy Policy and Terms and Conditions of Use, including investigation of possible violations;
  • c) Detecting, preventing or addressing technical, fraud and security issues;
  • d) Responding to User support requests;
  • e) Protecting the rights, property or safety of video-call.us, its Users and the public.

3. Data Collection

On our platform, information is collected in the following ways:

3.1. Information provided by the User: Identification information is requested for registration (full name, email and password) and credit card data, via filling by the User themselves.

3.2. Information provided indirectly: Operations performed by the User in the service will be recorded, such as registration, modification and deletion of patient/client records.

3.3. video-call.us does not collect Personal Data from children. If you know that a child has provided us with Personal Data, please contact us through the CONTACT form on the website or directly by email privacy@video-call.us. If we find that a child has provided us with Personal Data, we will take appropriate measures to remove the information and cancel the child's account.

4. Use of Personal Information

4.1. This agreement allows video-call.us to use your personal information for different purposes:

4.1.1. Full name: Used for registration and identification of Users in the service, filling out service provision and license agreements, verifying the legitimacy of parties to contract, searches in public agencies and regulatory entities, and billing.

4.1.2. Email: Used for login, system identification, sending information, materials and general communication from video-call.us.

4.1.3. Credit card data: Used to charge for services provided, plans acquired by Users, as well as extra services.

4.2. Sharing information with partners: Your data may be shared with partners to improve service provision, respecting the inviolability and confidentiality of communications made on the internet. No personal information may be publicly disclosed, only in a generic and non-identifiable way. The only exception is in cases where this information is required by law or court order.

4.3. Authentication and integration with Google Calendar: If integration with Google is needed for video-call.us events, the process will be carried out as follows: A permission will be sent to the user to authenticate in their Google account for authorization and subsequent integration. This authorization is sent directly to Google, which generates a "token" authentication to video-call.us, allowing data to be transmitted between video-call.us and Google. When the user creates an event in video-call.us, this information will be sent via secure environment to Google, which will create a calendar called "video-call.us" in this user's Google Calendar. video-call.us will only store the "identifier" of this created calendar and the events sent to Google. There is no possibility for video-call.us to access or share the user's Google account information, only the user who allowed this integration.

5. Integration with Third-Party Applications and Your Data

5.1. By installing or enabling the use of third-party applications with video-call.us services, the User will be allowing the providers of these applications to access certain personal data. We recommend carefully reading the Terms of Use and Privacy Policies of these applications before proceeding with use.

5.2. This exempts video-call.us from being responsible for any disclosure, modification or deletion of data shared through integration with third-party applications, so that only the services contained in the service are the responsibility of video-call.us. video-call.us is not responsible for or guarantees the availability of third-party services.

6. Platform Cancellation, Access Account Cancellation and Data Deletion

6.1. Access account cancellation: video-call.us may, at its sole discretion, warn, block, restrict, disable or prevent any User's access to the service without prior notice, whenever inappropriate conduct is detected, without prejudice to the measures it deems appropriate.

6.2. Access account deletion by User: Users who do not wish to continue using the service should opt for service cancellation, contacting video-call.us through its service channels (WhatsApp and email). It is emphasized that even with cancellation, the User must respect and meet all contractual, legal and financial obligations assumed to date.

6.2.1. By deleting the account, the User will be permanently ceasing use of the service and must export previously entered data, as the information will be permanently deleted from video-call.us within one (1) year, or when requested by the User, through the CONTACTS provided at the end of this Policy.

6.3. Data deletion: Users who request the deletion of their information will have all their personal data permanently deleted from video-call.us, except for access records (set of information referring to the date and time of use of a given internet application from a given IP address), which will be kept, under confidentiality, in a controlled and secure environment, for a period of 6 (six) months, under applicable data retention laws.

6.4. video-call.us cancellation: If video-call.us and its services are cancelled, VIDEO CALL LLC, the company responsible for creating and administering the service, undertakes to meet all legal requirements, permanently delete confidential data from Users and their patients, and maintain access records under confidentiality, in a controlled and secure environment, for a period of 6 (six) months.

7. Security

7.1. We implement appropriate technical and organizational protections to protect against unauthorized or illegal processing of Personal Data and against accidental or illegal destruction, loss, alteration, unauthorized disclosure or access to Personal Data. However, we inform you that we cannot completely eliminate security risks associated with the storage and transmission of Personal Data.

8. General Provisions

8.1. video-call.us has specific text to regulate the license of use, rights, duties, guarantees and general provisions: the Terms and Conditions of Use. These terms can be accessed on the video-call.us website, in the Information Security area.

9. Contact

9.1. video-call.us provides service channels to receive all communications that the User wishes to make. By email: to the email address privacy@video-call.us. By mail: 1209 N Orange Street, Wilmington, DE 19801, United States.

9.2. All requests must always be accompanied by the User's contact information, so that we can complete the service. Users will receive confirmation of receipt of contact and video-call.us will have up to 3 (three) business days to respond.

10. Google Limited Use Policy

10.1. video-call.us uses Google APIs to create a calendar for the user, create events in the calendar created for video-call.us, list the user's calendars and list events from all user calendars to offer scheduling functionality without interference. The use and transfer of information received from Google APIs by video-call.us adheres to the Google API Services User Data Policy, including Limited Use requirements.
