Terms of Use for the Video Call API from video-call.us
These Terms of Use ("Terms") govern the use of the video call API ("API") provided by B M GONTIJO, a legal entity incorporated as a Limited Liability Company, registered under CNPJ No. 35.211.047/0001-89, established at Praça da Matriz, No. 100, Centro, in the City of Bom Despacho, State of Minas Gerais – MG, ZIP: 35600-000 ("Company"), owner, maintainer, and operator of the video-call.us platform. By accessing or using the API, you ("User") agree to be bound by these Terms. If you do not agree with these Terms, do not use the API.
1. Definitions
For greater clarity, the following terms have the meanings below:
API: The application programming interface provided by the Company, based on WebRTC, which allows the integration of video call functionalities into third-party applications or websites.
User: Any natural or legal person who accesses or uses the API.
Service: The video call service made available through the API.
2. License to Use
The Company grants the User a non-exclusive, non-transferable, and revocable license to use the API exclusively in accordance with these Terms. The User is not permitted to sublicense, sell, distribute, or transfer the API, in whole or in part, to third parties without express authorization from the Company.
3. Usage Restrictions
The User agrees not to:
Modify, adapt, reverse engineer, or create derivative works of the API.
Use the API for illegal, immoral, or unauthorized purposes, which explicitly includes adult content.
Overload, interfere with, or attempt to overload the API infrastructure, including denial of service (DDoS) attacks or similar actions.
Attempt to gain unauthorized access to the Company's or other users' systems, data, or information.
Any use of the API contrary to these restrictions constitutes a violation of these Terms and may result in immediate termination of the User's access.
4. Prohibited Content
We emphasize that it is strictly prohibited to use the API for any activity related to adult content. This includes, but is not limited to:
Pornography or any sexually explicit material.
Promotion or facilitation of prostitution, sex trafficking, or sexual exploitation of any kind.
This prohibition is fundamental to ensure that the use of the API is aligned with the Company's values and applicable legislation. Any violation of this rule will result in serious consequences, such as:
Immediate termination of API access.
Possible legal action, including civil and criminal liability, depending on the severity of the violation.
5. Intellectual Property
The API, including its source code, documentation, design, and any related materials, is the exclusive property of the Company and is protected by copyright laws, trademarks, and other intellectual property laws applicable in Brazil and abroad. The User does not acquire any property rights over the API, except for the limited license to use provided in this document.
6. Confidentiality
The User agrees to keep confidential all non-public information provided by the Company related to the API, including, but not limited to, technical specifications, access keys, and operational data. This information may not be disclosed to third parties without the prior written consent of the Company.
7. Warranties and Disclaimers
The API is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of uninterrupted operation, absence of errors, or fitness for a specific purpose. The Company is not responsible for:
Interruptions, failures, or unavailability of the API.
Direct, indirect, incidental, special, consequential, or punitive damages arising from the use or inability to use the API, even if the Company has been informed of the possibility of such damages.
The User assumes all risks associated with using the API.
8. Indemnification
The User agrees to indemnify, defend, and hold harmless the Company, as well as its partners, directors, employees, agents, and affiliates, from any claims, liabilities, damages, losses, or expenses (including reasonable attorney fees) arising from or related to:
Improper use of the API by the User.
Violation of these Terms, including the use of adult content or any other prohibited content.
Infringement of third-party rights resulting from the User's use of the API.
9. Terms Modifications
The Company reserves the right to modify these Terms at any time, at its sole discretion. Changes will take effect immediately after publication of the revised version on the video-call.us website. The User's continued use of the API after such modifications constitutes acceptance of the updated Terms.
10. Termination
The Company may, at its sole discretion, suspend or terminate the User's access to the API at any time, without prior notice, for any reason, including, but not limited to:
Violation of these Terms, especially the use of adult content.
Use of the API in a way that harms the Company or third parties.
Operational or legal needs of the Company.
After termination, the User must immediately cease using the API and destroy any related materials obtained through it.
11. Applicable Law and Jurisdiction
These Terms will be governed and interpreted exclusively in accordance with the laws of the Federative Republic of Brazil. Any dispute, controversy, or claim arising from or related to these Terms will be submitted to the exclusive jurisdiction of the courts of the Comarca of Bom Despacho, Minas Gerais, with waiver of any other forum, however privileged it may be.
12. General Provisions
Invalidity: If any provision of these Terms is deemed invalid or unenforceable by a competent court, such provision will be eliminated, and the others will remain in full force and effect.
No Waiver: The Company's failure to exercise or enforce any right or provision of these Terms does not constitute a waiver of such right or provision.
Entirety: These Terms represent the complete agreement between the Company and the User regarding the use of the API, superseding any previous agreements.
